1. Agreement to Terms

By accessing and using FluencyX's website, mobile applications, and services, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. App Store Terms and EULA

If you downloaded our application from the Apple App Store or Google Play Store, the following terms apply:

  • These Terms are between you and FluencyX, not Apple Inc. or Google LLC.
  • Apple and Google are not responsible for the App or its content, nor are they responsible for providing any maintenance or support services.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price (if applicable).
  • You must comply with applicable third-party terms of agreement when using the App.

3. Subscriptions and Payments

Some features of FluencyX require a paid subscription. Subscriptions may be purchased directly through our website or via in-app purchases through the Apple App Store or Google Play Store.

  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Cancellation: You can cancel your subscription at any time through your account settings or your respective App Store subscription settings.
  • Refunds: All purchases are final. We do not offer refunds for partial billing periods unless required by law or respective App Store policies.

4. Use License and Conduct

Permission is granted to temporarily access the materials (information or software) on FluencyX for personal, non-commercial transitory viewing only. Under this license you may not:

  • Modify or copy the materials.
  • Attempt to decompile or reverse engineer any software or AI models contained within the service.
  • Use the AI assessment tools to generate hateful, abusive, clinical misrepresentation, or illegal content.
  • Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions at our sole discretion.

5. Disclaimer

The materials on FluencyX are provided on an 'as is' basis. FluencyX makes no warranties, expressed or implied, regarding the AI assessment accuracy, or fitness for a particular purpose.

6. Limitations

In no event shall FluencyX or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or failure to pass official examinations) arising out of the use or inability to use the materials on the website or mobile apps.
